Former nominated senator of Jubilee Alliance Party has moved to court seeking postponement of next year general polls citing lack of quorum to IEBC while declaring election date.
On a petition filed under certificate of urgency, the former senator said that the intended presidential elections of 9th August 2022 are imposed on the people of Kenya through an administrative fiat of the 1st respondent and therefore illegal, irregular and illegitimate.
The petition comes a few days after the Appellate Court upheld the High Court ruling that IEBC had no proper quorum while conducting verification of BBI signatures.
Law Society of Kenya led by Nelson Havi had also threatened to move to court in an attempt to force IEBC to start afresh all the general election preparation due to lack of quorum.
IEBC has, however, filed a petition at the supreme court seeking nullification of the high court and appellate court ruling on quorum of the independent body.
If the petition goes through, we might end up not having the general elections next year.
